Liability for contents
The contents of our pages were created with the utmost care. However, we cannot guarantee the accuracy, completeness and timeliness of the content. As a service provider, we are responsible for our own content on these pages in accordance with § 6 para.1 MDStV and § 8 para.1 TDG under the general (German) laws. However, service providers are not obliged to monitor third-party information transmitted or stored by them or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information according to the general laws remain unaffected. General data protection regulations
Insofar as personal data (for example name, address or e-mail addresses) is collected on our pages, this is always done on a voluntary basis as far as possible. The use of offers and services is, as far as possible, possible without providing personal data. The use of DENKZEUGE online services and tools requires the specification of an arbitrary email address and a user name for the initial registration and execution. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited promotional information, such as spam e-mails.
Security and anonymity
DENKZEUGE takes a highly responsible approach to security and makes every effort to protect the data entrusted to DENKZEUGE by its customers from unauthorized access.
Consent
By concluding the contract, the customer consents to the collection, processing and use of personal data by DENKZEUGE or by third parties in the name and on behalf of DENKZEUGE, or by third parties related to the invited customer, on the basis and to the extent of the data protection provisions set forth below. The consent of the customer is ensured by DENKZEUGE via an opt-in click procedure.
Revocation
The customer has the right at any time to revoke the consent to the use of his data – as described in detail below – in whole or in part within the framework of the legal requirements. He also has the right to object to the use of his anonymized or pseudo-anonymized data. For the revocation, it is sufficient to send an e-mail with the following information: E-mail address or user name stored at DENKZEUGE.
The e-mail is to be sent to support@DENKZEUGE.com. The customer can also send his revocation in writing to DENKZEUGE GmbH, – Customer Service -, Kapellenweg 8, 79183 Waldkirch. Data will be stored for at least 3 months from registration. A legal claim to longer storage of data does not exist.
Prohibition of tying
DENKZEUGE does not make the use of its services dependent on the customer’s consent to the use of his data for purposes other than the establishment and fulfillment of the contract.
Privacy Policy
Collection, processing and use of personal data
In order for DENKZEUGE to provide the services described in more detail in the General Terms and Conditions, it is necessary to collect, process and use personal data that the customer provides, among other things, during the registration process or when filling in the Denkzeuge® IMA©. Personal data is individual information about personal or factual circumstances of a specific or identifiable natural person. During the registration process, the customer is requested to provide certain minimum information, without which the registration cannot be completed. These mandatory informations are: User name, email address, password, place of residence.
The access to DENKZEUGE takes place via the e-mail address given by the customer and the password chosen or given by them (so-called credentials). In the Denkzeuge®-IMA© following the registration the following data are requested
1) Answers and assessments to a series of personal questions with which the profile is created.
2) voluntary data on zip code, salary, profession, income, country
All data in DENKZEUGE-ProCoach are only accessible to the management of DENKZEUGE GmbH, based in Waldkirch.
Each time DENKZEUGE services are accessed, usage data is stored and transmitted in the respective Internet browser and saved in log files, so-called server log files. These data are:
-IP address (Internet Protocol address) of the accessing computer
-User ID on the DENKZEUGE platform
-Date and time of retrieval
-Status message about whether the retrieval was successful
-Submitted data
In the so-called login records, the following usage data is stored each time the customer logs into the network:
-Date and time of login
-User identification on the Pocketcoach.ai platform
-IP address (Internet Protocol address)
-Session cookie number
-Session identification number
-Submitted data
DENKZEUGE does not collect any further sensitive data in the sense of § 3 No. 9 BDSG.
Purpose
DENKZEUGES main purpose in collecting personal data is to enable the Customer to use the DENKZEUGES service in a safe, smooth, efficient and personalized way. Among other things, the personal data of the customers are used for the following:
-Providing the services and customer service requested by the Customer;
-Adjustment, measurement and improvement of DENKZEUGE services, content and advertising; in particular, also measures ensuring the quality of DENKZEUGE services, such as customer surveys (email and telephone) and review of customer communications between customers and employees of the Customer Service Department.
-Providing DENKZEUGE services according to the framework conditions given by the customer.
-Informing about new or complementary THINK TOWARDS products based on the framework conditions given at the customer;
-Preventing, detecting and investigating potentially prohibited or illegal activities and enforcing DENKZEUGE’s terms and conditions;
-Resolving disputes and resolving problems;
Disclosure of personal data to third parties
DENKZEUGE does not sell, exchange or otherwise make unauthorized use of personal data and information. DENKZEUGE also does not disclose personal data of customers to third parties other than licensed DENKZEUGE partners or the inviting parties, unless the customer has given his or her consent to do so or DENKZEUGE has a legal obligation to disclose the data.
Third parties do not include external service providers of DENKZEUGE who provide services in the name of and on behalf of DENKZEUGE. This includes, for example, payment providers, collection agencies or email or newsletter senders commissioned by DENKZEUGE.
Use of personal data for advertising
DENKZEUGE will send its customers, within the framework of the contractual relationship, information on new or supplementary DENKZEUGE products tailored to the respective customer. Newsletters as well as information about products and services will only be sent to the customer if the customer explicitly requests it. If the customer no longer agrees with the sending, he can object to this at any time. At the end of each e-mail/newsletter there is a clear reference to the possibility of objection and a corresponding link. Furthermore, the customer can object to the sending of e-mails at any time in writing.
Use of analysis programs
DENKZEUGE carries out or has carried out analyses of the behavior of its customers in the context of the use of its service. For this purpose, anonymized or pseudonymized usage profiles are created. The usage profiles are created for the sole purpose of constantly improving DENKZEUGE’s service.
Use of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google, Inc („Google“). Google Analytics uses „cookies“, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymization is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Use of social plugins
Denkzeuge GmbH uses advertising measures of the following providers:
Facebook, Twitter, Google +, YouTube, LinkedIn, Instagram.
These providers are linked to our website to enable the visitor to contact us via these media. By visiting the website, but especially through interaction (e.g. likes, re-tweets, etc.) anonymous usage data may be generated.
Integration of third-party services and content
It may happen that content or services from third-party providers, such as city maps or fonts from other websites, are integrated within our online offer. The integration of content from third-party providers always requires that the third-party providers perceive the IP address of the user, since without the IP address they could not send the content to the user’s browser. The IP address is thus required for the display of this content. Furthermore, the providers of the third-party content can set their own cookies and process the users‘ data for their own purposes. In doing so, user profiles can be created from the processed data. We will use this content in a data-saving and data-avoiding manner as far as possible and select reliable third-party providers with regard to data security.

Mailpoet emails
If you have subscribed to our newsletter or are a member of our website (you can sign up) or have made a purchase on our website, there is a high probability that you will receive emails from us. We will only send you emails if you have consented to receive them or if they relate to services we have offered you.
To send you emails, we use the name and email address you have provided to us. Our website records the IP address you used when signing up for the service to prevent abuse.
The website may send emails using the Sendgrid or amazon email sending service. This service allows us to record opens and clicks on our emails. Members of our team have access to the information you provide. For example, both administrators and store managers can access the following:

Furthermore, we use the plugin Mailmunch, a service that is linked to Mailchimp from the provider SixMix LLC, 1110 Fidler Ln Apt 708, Silver Spring, Maryland 20910-3451, USA, for the simple integration of newsletter plugins within the framework of our legitimate interest in a technically flawless online offer and its economically efficient design and optimization pursuant to Art.6 para. 1 lit.f DSGVO. By using Mailmunch, information about your use of this website (including your IP address) may be transmitted to a Mailmunch server and stored there, in particular through active Java scripts.
